Уф, чем больше читаю про Eligibility, тем больше у меня сомнений насчет этого FSA. Может я и не прав, поправьте, плз.

When an employee needs care for a dependent in order to work, they qualify to use this account when one of the following applies:
•the employee is single and has an eligible dependent
•the employee is married and their spouse works, or is looking for work
•the employee is married and their spouse is a full-time student for at least five months of the year
•the employee is married and their spouse is disabled and unable to provide for their own care
When a spouse is not working, the employee should not use this account.
•If an employee is married, the annual contribution cannot be more than their spouse’s earned income, or their own earned income (after all salary reductions), whichever is less.
Ситуация: супруга сейчас не работает, но скорее всего будет работать (надеюсь) в 2012 году. Я не могу понять разницу между “looking for work” и “is not working”. Иными словами, если супруга выйдет на работу и за 2012 год заработает минимум $5000 (тоже не ясно, gross/net здесь имеется в виду), то все нормально, я могу эти $5000 заклеймить, если не выйдет на работу или выйдет и не заработает $5000 - то все\часть пропало?
Еще вопрос все-таки про tax-deductions которые позволяет сделать IRS напрямую.

Employees cannot apply the same expenses to both the Dependent Care Account and this credit. Тут я вообще запутался. Т.е. я должен решить: или я отчисляю $5000 pre-tax через работодателя (получая их обратно через reimbursement), или имею возможность сделать tax return на $3000 через IRS? Или здесь имеется ввиду, что нельзя клеймить одни и те же затраты, покрытые через FSA, через IRS? Т.е. если я планирую затрат на $8000 и более, то я могу $5000 покрыть через FSA и еще на $3000 получить tax return через IRS, верно?
