Держим руку на пульсе в очереди на визу,петиция I-130 категория 3,дата подачи декабрь 2002.Данные за декабрь по Visa Bulletin -июнь 2002,и вот сейчас вышли данные на январь 2011-визы по петициям январь 2001.Шок.:letmein::letmein::letmein:

И что же теперь будет - мы уже оплатили 88$ за форму I-864 и за иммиграционную визу 404$??? А дата приоритета откатилась назад на 2 года? процесс оформления визы приостанавливается? =0

Вот не могу понять. За декабрь виза бюллетень, 1 категория- февраль 2006. Если приорити дэй был например февраль 2006 г (значит все у кого была петиция на эту дату) уже получили визы или же получат в яваре… Так каким “макаром” откатили приорити дэй на январь 2005 г ? Позвонили в визовый центр, задали вопрос, ответа вразумительного не получили. Сказали есть другие вопросы.

“Догадка”.
В качестве рабочей версии происходящего:
может подсчитали кол-во детей нелегальних иммигрантов (а Конгресс уже принял закон о их (детей) “натурализации” (это верно, но не дословно) ) и скаканули назад, “урезав” лимиты “вновь прибывающим”.
Ну и тогда вопрос? Если так, то на сколько скаканут еще назад, когда закон заработает и СЧЕТОВОДЫ удивятся тому, что посчитали далеко не ВСЕХ.

Прошу сказать, что я не права, а вся конспирология от “радости” от опубликования январского бюллетеня.

Регресс связан с излишне большим ускорением очереди в прошлом году, вероятно не справляются с потоком обращений. Вот и приостановли, временно. Об этом писали в декабарьском :

Family-sponsored: From early 2009 through September 2010, the level of demand for numbers in the Family-sponsored preference categories was very low. As a result, the cut-off dates for most Family preference categories were advanced at a very rapid pace, in an attempt to generate demand so that the annual numerical limits could be fully utilized. As readers were advised in previous Visa Bulletins providing projections of visa availability (e.g., April 2009, January 2010, May 2010, July 2010), such cut-off date advances could not continue indefinitely, and at some point they could slow, stop, or in some cases retrogress.

The level of demand which has been experienced during FY-2011 has resulted in most of the worldwide cut-off dates being held for the month of December. At this time it is not possible to predict when or if these dates may advance further, and there is a distinct possibility that retrogressions could occur as early as January if demand within the established cut-off dates does not appear to be subsiding.

ДаДаДа. Спасибо. Это я читала здесь у Вас(?) и на VISA ранее. Поэтому - не плачу…

…а просто - РыдААААю!

Вероятно, тем кому ждать “два -четыре” года стоит присмотреться к визе E2. В моем случае priority date “november 2007” есть возможность получить гражданство Украины по праву рождения, есть сбережения около 150 000 $. Может и ждать не стоит? Вот только какой малый бизнесс может оказаться там подходящим для этой визы?

Eligibility for the E-2 Visa

Alien investors who meet the following requirements may qualify for an E-2 visa:

  The investor's home country maintains a treaty of commerce and navigation or bilateral investment with the United States;
*

  The investor has made a "substantial investment" (typically $75,000 or more) in a U.S. business;
*

  The business in which the investment was made is not less than 50 percent owned by citizens of the treaty country;
*

  The investor intends to come to the United States to direct the operations of the enterprise in a capacity that is either executive, supervisory, or involves specialized skills;
*

  The investor possesses means of support independent of the enterprise.

It may benefit applicants for an E-2 visa to demonstrate that their investments will result in the creation of jobs within the United States.
Substantial Investment

There is no fixed amount of investment necessary to qualify for an E-2 visa, although as a general rule of thumb some immigration lawyers suggest that a minimum investment of $25,000 is necessary. The investment must amount to not less than fifty percent ownership in an enterprise that generates active income (as opposed to “passive income”, such as that generated from rental property).

Ordinarily, the investment will be made by the E-2 applicant. There may, however, be circumstances in which an E-2 visa will be issued to an employee of a foreign company that qualifies as a treaty investor, provided the employee comes the United States in an executive or supervisory capacity to direct the enterprise or possess a specialized skill required by the enterprise.
Duration and Extension

An E-2 visa is issue for a two year period, and is renewable for an indefinite period as long as the visa holder continues in the same capacity with the business, and the business is actively engaged in trade or services.
Visa Eligibility for A Spouse and Minor Children

The spouse and unmarried minor children of an E-2 visa holder will also qualify for E-2 visas. These visas, however, will not automatically grant the spouse and children the right to work in the United States.

Кто не справляется с потоком каких обращений? НВЦ-же сами написали, что они генерировали спрос путём увеличения количества обрабатываемых кейсов (поэтому очередь ускорилась), чтобы выбрать ежегодную квоту. Квоту-то выбрали, а уже обработанные кейсы, для которых не хватило виз оставили дожидаться следующего года, когда будет новая квота. Вот откуда появился регресс. Те, у кого дата стала каррент до Декабря, в Январе должны будут подождать, пока не будут выданы визы тем, чьи доки уже обработали, но виз на них не хватило. Думаю, что в Феврале-Марте очередь вернётся на место, даже надеюсь, я б сказал :slight_smile:

The following legislative agenda for the 110th Congress lays out the critical reforms to federal immigration laws and enforcement capabilities needed to redirect U.S. immigration policy and get it back on track.

  1. Cut the Numbers. The United States currently admits over one million legal permanent residents every year. This is equivalent to annually adding a city the size of Dallas, straining our communities, health care, education, and overall infrastructure. In fact, the Associated Press recently reported that New York City planners currently project the city’s population growth will lead to an all-day rush hour by the year 2030. This level of immigration is unprecedented and unsustainable—a conclusion also reached by the bipartisan Jordan Commission in 1995. The growth in the number of legal immigrants is mainly the result of ever-expanding family-based preference system. It is further compounded by the increase in employer-based visas lobbied for by big business as they seek to import cheap foreign labor and increase profits. FAIR believes that a sustainable level of immigration is approximately 300,000 annually. To cut the numbers while allowing for the maintenance of nuclear families, FAIR advocates the following measures:
    +Take an immigration time-out of most immigration to relieve pressure on the system, eliminate backlogs, and start setting an enforceable annual cap.
    +Eliminate family preferences for adult siblings and adult sons and daughters
    +Eliminate the visa lottery
    +Repeal INA § 245(i)
    +Eliminate birthright citizenship legislatively
    +Reform temporary protected status, asylum and refugee laws to limit abuse.

How Would a Time-Out Work?

FAIR advocates a time-out that would continue only immigration of the spouses and minor children of U.S. citizens and some legitimate refugees. Until it can be shown that there is a national need for higher levels, immigration should be kept low.

Congressman Tom Tancredo (R-CO) has introduced a bill in the U.S. House of Representatives that would enact a five-year moratorium on many categories of immigration, including extended adult relatives, and would significantly cut back on the number of skilled workers and refugees.

Перечитав информацию, возникает вопрос - как отразится этот закон на 3 и 4 категории,ожидающие дату собеседования и оплатившие все оплаты?

т.е. для жен permanent residents иммиграция тоже будет приостановлена???
