Добрый день сегодня получил забавное письмо,от не пойму кого,но с полными моими данными о том что когда я учился в компании Свифт,мне не доплачивали типо и вот кто то добрый готов за это бороться.Кто с этим сталкивался и что это такое?

If you were a Trainee Truck Driver for Swift Transportation, Inc. and/or Swift Transportation Company of Arizona, LLC (“Swift”) between January 6, 2014 and present, please read this notice.

A lawsuit is pending in federal district court claiming that Swift has failed to pay its Trainee Truck Drivers minimum wage, in violation of the Fair Labor Standards Act.
The Court authorized the parties to send notice of this lawsuit under the Fair Labor Standards Act to individuals employed by Swift as a Trainee Truck Driver at any time during the period of January 6, 2014 to the present.
Swift denies that the claims have merit. Swift contends that it has paid the Trainee Truck Drivers properly under the Fair Labor Standards Act and that the matter cannot proceed as a collective action.
The Court has not decided who is right or wrong.

  1.       WHY DID I GET THIS NOTICE?
    

On August 30, 2017, the Federal District Court overseeing this case granted “conditional certification” for the case to proceed as a “collective action” and directed that notice of the lawsuit be sent to current and former Trainee Truck Drivers of Swift. This notice has been sent to you because Swift’s records indicate that you are or were a Trainee Truck Driver employed by Swift during the relevant time period. This notice is intended to inform you of this lawsuit and of your right to join it as an opt-in plaintiff.

2. WHAT IS THE LAWSUIT ABOUT?
The Plaintiffs allege that Swift has denied minimum wages to its Trainee Truck Drivers by requiring them to perform work off-the-clock, without compensation. The categories of work Plaintiffs allege were not compensated include time spent: riding in the truck while in route; studying; and performing other productive tasks while off-the-clock. Plaintiffs allege that the off-the-clock work results in the denial of minimum wage. Swift denies that the claims have merit. Swift contends that it has paid the Trainee Truck Drivers properly under the Fair Labor Standards Act.

The lawsuit is entitled Julian, et al. v. Swift Transportation Co. of Arizona, LLC, et al., Case No. 2:16-CV-00576-ROS, and is filed in U.S. District Court for the District of Arizona.
3. WHAT ARE MY CHOICES?
If you worked for Swift as a Trainee Truck Driver in the United States at any time from January 6, 2014 to the present, you are eligible to join this action as a plaintiff. Joining this action does not necessarily mean that you will obtain money, only that the Court will determine whether your rights have been violated under the Fair Labor Standards Act.

To take part in this lawsuit, you must submit a “Consent to Join Collective Action” Form. There are two ways to submit the form.

4. WHAT HAPPENS IF I JOIN?
If you join, the named Plaintiff in the case and the lawyers listed below will represent you and work with you to try to obtain relief on your behalf. The Court or a jury will determine whether your rights have been violated. You will be bound by the Court’s judgment, whether it is favorable or unfavorable to you.

If there is a recovery, Plaintiffs’ attorneys will be compensated for their fees and costs either by receiving a portion of the recovery or by a separate payment by Swift (or a combination of the two), in an amount approved or determined by the Court. If there is no recovery, you will not be required to pay Plaintiffs’ attorneys for any of their fees or costs.

Your decision to submit a Consent to Join Form does not necessarily determine whether or not you will be required to participate in discovery during this case. Discovery might be taken from both those who submit a Consent to Join form as well as those who do not.
5. WHAT HAPPENS IF I DO NOT JOIN?
If you do not join, you will not be entitled to share in any amounts recovered under the FLSA in this action, if any. Your rights under the FLSA will not be affected by any judgment issued or settlement approved, if any, by the Court in this case - whether it is favorable or unfavorable.
6. HOW DO I JOIN?
If you wish to join this lawsuit, you must either: (1) fill out and sign a “Consent to Join Form” electronically at Julian v Swift Transportation, Inc., using your Individual ID: or (2) sign and mail the below “Consent to Join Form” to the following address: Julian v. Swift Transportation Co., c/o Heffler Claims Group, P.O. Box 59164, Philadelphia, PA 19102-9164. FORMS CANNOT BE SUBMITTED BY EMAIL.

The signed Consent to Join form must be either electronically submitted on the website by 11:59 p.m. Pacific time on January 16, 2018 or postmarked by January 16, 2018 for it to be considered timely.

If your Consent Form is not electronically submitted or postmarked by January 16, 2018, you may not be eligible to participate in this lawsuit. Signing a Consent Form does not guarantee any recovery in this lawsuit. 7. NO RETALIATION PERMITTED.
It is a violation of federal law for Swift to discriminate in any manner, or to retaliate against you for taking part in this case. да, часто. Партнер уже написал.

Мне так когда-то прислали что-то около 20 баксов когда засудили SimpleMobile. Присоединяйся, от тебя ничего не требуется. Пришлют копейку если дело выгорит.

А разве не надо платить если проиграем?

Не надо.

Ты нужен “для веса”. Одно дело, когда кто-то один подает в суд на компанию, и другое дело, когда предоставляют “официальный список из тысячи пострадавших”.

Я так понимаю, что чем больше народу впишется, тем больше получат адвокаты, так как они иногда могут получать исходя из “тариф в час"x"количество часов потраченных на человека"x"на количество представлемых людей”. Если это будет так - за ваше согласие участвовать кто-то получит, скажем, тысячу. Вы получите, при хорошем раскладе, сумму на один обед. Но в принципе для этого вам надо только подписать бумажку и отправить. Стоит ли это усилий - решать вам. Если речь идет о крупной недостаче лично вам, то иногда есть смысл судится самому, потому что участвуя в class action вы это право отменяете.

Не class action а collective action. Хотя для целей ТС суть от этого не меняется.

3 года назад купил я новую машину с бесплатной годичной подпиской на радио Sirius XM. Год прошел, подписка истекла, и эти черти начали мне названивать с предложением продлить эту подписку за деньги. Мне это радио не нужно, я отказывался. Донимали меня долго, звонили с разных номеров, я их блочил, просил нормально не звонить когда они все-таки дозванивались, но эти козлы продолжали меня доставать. И вот где-то с год назад приходит мне такая же бумажка, типа кто-то хочет засудить этот Сириус за то что они использовали какие-то автоматические системы дозвона и доставали людей. Они пошли на settlement и предлагали три месяца своего дурацкого радио либо сколько-то денег. От халявного радио я отказался, и вот сегодня пришел чек на 81 доллар.
Я очень рад, реально был зол на эту контору.

Сегодня получил обновление кейса,но что то до конца не понял,я так понимаю они согласились на компенсацию котрую поделят между участниками кейса.

  1. WHAT IS THIS CASE ABOUT?
    This case was filed as a “Collective Action” lawsuit under the Fair Labor Standards Act (FLSA), a federal law guaranteeing minimum wage to employees, among other things. The lawsuit alleged that Swift did not pay Trainees at least minimum wage for all the time they worked in the training period of their employment with Swift. The training period typically lasted approximately 6 weeks. Swift denied Plaintiffs’ claims and maintained that it did not violate any law.

The lawsuit was originally filed by Pam Julian, a former Trainee of Swift. She is the “Named Plaintiff.” On August 30, 2017, the federal court presiding over the lawsuit granted a motion for “conditional certification,” which gave other individuals an opportunity to “join” the case as “opt-in plaintiffs” or “Collective Members” if they worked as Trainees for Swift at some time between January 6, 2014 through January 16, 2018, and timely submitted a “consent to join” form. Approximately 9,577 individuals submitted consent to join forms before the deadline. You are one of these individuals.

Your consent to join form designated the Plaintiffs’ attorneys, listed below, to litigate and resolve the case on your behalf. The Plaintiffs’ attorneys thoroughly litigated the case for several years. On December 28, 2018, they won a “motion for summary judgment,” ruling that Trainees were entitled to be paid at least minimum wage for time logged as “sleeper berth” in excess of eight hours per day and that Swift was not compensating Trainees for this time. On December 27, 2019, the Court awarded $7,839,834 in damages to compensate the 9,577 opt-in plaintiffs for this unpaid time. The Court later scheduled a trial to occur in October 2020 to determine any additional amounts that might be owed, including additional unpaid time and “liquidated damages.”

Swift objected to these rulings and stated its intent to make an appeal to have them reversed.

On August 10, 2020, the Parties presented their competing arguments and evidence to an experienced mediator to attempt to resolve the lawsuit. After the mediation, the mediator made a “mediator’s proposal” to resolve the case for a total of $14,000,000, as further described below. The Parties accepted this proposal.

While the Parties continue to dispute whether Swift has violated the law and, if so, the amount that would be owed, the Parties also recognize that there are various legal disputes as to requirements for how Swift must pay its Trainees. The Parties also recognize the risks of an appeal, and the delays of further litigating the case through trial and appeal. The Named Plaintiff and Plaintiffs’ attorneys believe, after a thorough evaluation of the law, evidence and uncertainties, that the Settlement is in the best for the collective of opt-in plaintiffs.

The court overseeing this case has approved the Settlement and ruled that it is a fair and reasonable resolution of a bona-fide dispute.

  1. WHY DID I GET THIS NOTICE?
    This Notice has been sent to you because you worked as a Trainee truck driver for Swift at some time between January 6, 2014 through January 16, 2018, and timely submitted a “consent to join” form in the case of Julian, et al. v. Swift Transportation Co. of Arizona, LLC, et al., Case No. 2:16-CV-00576-ROS.

  2. WHAT ARE THE KEY TERMS OF THE SETTLEMENT?
    Swift has agreed to pay a total Settlement Amount of fourteen million dollars ($14,000,000) to resolve this lawsuit. The total Settlement Amount provides for the following: (1) individual Settlement Payments to the 9,577 Collective Members (including you); (2) the costs of administering the Settlement and processing the Settlement Payments, which are $116,776; (3) attorneys’ fees of one-fourth of the total Settlement Amount ($3,500,000) and the attorneys’ out-of-pocket litigation costs of $308,153.88; and (4) a service payment to the representative Plaintiff, Pamela Julian, of $15,000, in recognition for the significant time, effort and risks she took in initiating and prosecuting the case.

The settlement contains a release of any claims pertaining to alleged unpaid wages (including minimum wage and overtime) during any time spent as a Trainee for Swift between January 6, 2014 through January 16, 2018. This means that you are no longer able to bring a lawsuit or assert legal claims against Swift for alleged unpaid wages as a Trainee during this time period. The release does not cover any other claims or any other time period.

  1. WHO ELSE IS RECEIVING A SETTLEMENT PAYMENT?
    The 9,577 current or former Swift Trainee truck drivers who filed written consents to join this action under 29 U.S.C. § 216(b) will be sent a Settlement Payment.

  2. HOW WAS MY SETTLEMENT PAYMENT DETERMINED?
    The “Net Settlement Amount” remaining for distribution to the Collective Members, after subtracting all attorneys’ fees and costs, administration costs, and service payments, as listed in Section 3 above, is $10,060,070.12. This “Net Settlement Amount is divided between the 9,577 Collective Members who submitted timely consent to join forms and are eligible to participate in the settlement. The Net Settlement Amount will be distributed equally among the Collective Members. Your payment is the same amount as the payments being made to all the other Collective Members.

  3. HOW WILL MY SETTLEMENT PAYMENT BE ALLOCATED FOR TAX PURPOSES?
    For tax purposes, the Settlement Payments are allocated as 1/3 wages, 1/3 liquidated damages and penalties, and 1/3 interest (1099 INT income). Legally-required employee tax withholdings and employer payroll taxes are deducted from the portion of each Settlement Payment allocated as W-2 income. Please note that no tax advice is being provided in connection with this settlement. You will need to speak with an accountant or other tax professional about any tax implications of your Settlement check.

  4. HOW LONG DO I HAVE TO CASH MY SETTLEMENT CHECK?
    You must cash the Settlement check within 180 days of its issuance to receive your share of the Settlement. If you misplace or no longer have your Settlement check, you can contact the Settlement Administrator at the contact information listed below to issue a new check. However, once a new check is issued, the Settlement Administrator will put a stop payment on your original check, and you will no longer be able to cash it even if you later find it. You will have 90 days to cash any subsequently issued check.
