DA: Racine shooting suspect could face life
MOBILE, Ala. (WALA) - Now that Trayon Washington is behind bars , Mobile County District Attorney Ashley Rich is speaking about what sentence he could face if convicted.
Police say Washington, 17, is responsible for the death of Wendy Fisher. Fisher was shot and killed outside of her home on Racine Avenue on Saturday.
Washington is charged with murder, not a capital charge. District Attorney Ashley Rich says she intends to push for the harshest penalty but the law only allows so much.
Officials said at 17 years old, Washington is no stranger to the justice system.
“He has an extensive juvenile history,” said Rich.
Last October there was a raid on Phillips Lane where 10 people were arrested including a 17-year-old. That’s the same street listed as Washington’s address on his arrest record.
Two months later, Washington was booked into Metro Jail charged with two counts of receiving stolen property and possession of a controlled substance. Two months after tha, he was booked again on charges of receiving stolen property and burglary.
The day Washington was arrested for the murder of Fisher, he was scheduled to appear in court for some of those charges.
"Unfortunately, he has not been convicted in any of those cases so those cannot be used for habitual offender purposes, and they will not be able to be mentioned at the trial,” said Rich.
Rich said Washington’s age won’t play a role if he is convicted. She said a possible sentence could range from 10 to 99 years or life with the chance of parole.
That could change if the charge is upgraded to a capital offense. According to Alabama law, a “Murder committed by or through the use of a deadly weapon fired or otherwise used within or from a vehicle,” is a capital offense.
"We have to do a little more investigating about whether or not the shots were fired inside the vehicle or outside the vehicle,” said Rich.
According to witnesses, the shooter was outside the car when the shots were fired.
Rich said that is just one thing to consider in the discussion to upgrade the charge. What they will use in court, Rich said, is the nature of the crime.
"This was a senseless act of violence it was absolutely horrific,” said Rich.
Rich said Washington will face the murder charge and then go to court for the pending felonies.
As for the others who were believed to be in the car at the time of the shooting, no charges have been filed but they are being questioned according to Rich.
