в США нахожусь уже почти полгода, истекает белая карта. Буквально пару дней назад при прохождении интервью на работу мне предложили визовую поддержку. Я уже через неделю возвращаюсь в Россию.
С чего начинать и мне в России, и работодателю тут? Почитала весь форум, полазила на сайте Посольства, но пошаговых действий так и не поняла.
Сайт Посольства информирует , что от работодателя нужна одобренная Immigration форма I-129. Это единственная бумага от работодателя?
Также не очень понятен вопрос по квотам и дате начала работы после получения визы.
Пожалуйста, подскажите и разжуйте, кто проходил эту процедуру.
Если ваш работодатель никогда не подавал петиции на рабочую визу, то ему нужно срочно найти юриста, который это уже делал. Подача петиций уже началась, и сколько она продлится никто не знает. Поэтому время очень ограничено.
А так требования стандартные - наличие высшего образования и опыта работы по специальности (требования к вам), реальный бизнес, наличие работников и нормальное финансовое состояние (требование к работодателю). В деталях работодателю все объяснит юрист, и он же будет заниматься подачей всех бумаг.

сами - это сами, без участия юриста. Сможет ли работодатель самостоятельно пройти все процедуры, каковы его пошаговые действия?
Юрист тоже кушать хочет:), но если в этом пути всего 2-3 бумажки, то вполне справимся и без него.

Повторюсь. Если работодатель сам не заполнял хотя-бы десяток петиций на рабочую визу, то лучше не рисковать. Да, в принципе там нет ничего сложного - всего-то нужно заполнить несколько форм, сделать эвалюирование вашего диплома, написать сопроводительные письма, предоставить финансовую отчетность. Делов на пару дней. ЕСЛИ ЗНАЕШЬ. Но самостоятельное изучение данного вопроса займет не одну неделю, и если хотя-бы одной закорючки или крестика в форме не будет хватать, то формы в полном составе отправятся назад, “на доработку”. А как я сказал, никто не может сказать, когда прекратится прием документов в этом году.

в прошлом году квоты закрылись только в декабре, надеюсь, что мы успеем.
Мы будем делать сами. И сюда я пришла с конкретным вопросом - что заполнять в первую очередь и куда отправлять, что во вторую…

Пока что нашла инфо, что работодатель пишет заявление в Мин Труда об условиях труда на фирме и т.д. ( какая форма и номер заявления, чтобы скачать?), и сразу, не дожидаясь одобрения от Мин Труда, можно отправлять в СИН прошение I-129.

Name and job title of person who will sign the forms on behalf of the company
Name and address of company. If foreign worker will be working at a client site, give us the name of the client site company and its physical address.
Informational brochures/promotional literature about the company. If this is a new company just starting up we need financial information about the company such as bank statements, most recent income tax return, articles of incorporation, business plan, financial statements or any documentation which will prove that the company is lucrative and can pay the salary of the foreign worker you want to hire.
Employer Federal Tax I.D. #, year company was established, approximate number of employees and approximate gross and net annual income
Telephone number and fax number for company
Client site letter on the client site’s letterhead. We will be happy to assist you with language necessary for this letter to be most effective.

Повторюсь, если ваш работодатель НЕ МОЖЕТ найти эту информацию самостоятельно, то я уверен со 100% вероятностью, что он НЕ СМОЖЕТ заполнить все требующиеся документы правильно.
PS. Не рассчитывайте на то, что квота будет открыта очень долго. В том году открытие виз пришлось на самый пик рецессии, поэтому много компаний, которые подавали на рабочие визы, были вынуждены отозвать свои петиции. Не думаю, что в этом году будет то же самое. Два года назад квота была выбрана в течение нескольких дней…
