principally-at-fault for an accident. We are required to notify you of the results of our investigation. Our
determination whether the driver was principally at-fault may affect your eligibility for a Good Driver Discount
and may affect your driving safety record (one of the mandatory rating factors in California), with respect to
future automobile insurance.
Based on our investigation we have determined that the actions or omissions of our insured driver contributed
at least 51% of the legal cause of the above-referenced accident and that the accident resulted in either bodily
injury (or death) and/or property damage in excess of $1,000. Our investigation included consideration of the
facts of the accident, certain regulatory presumptions, and evidence of bodily injury or death, and/or evidence of
property damage and its cost of repair or replacement.

Sometimes, after we make a payment on a claim, we pursue reimbursement for the amount we have paid
from third parties who were responsible or partially responsible for the accident which prompted the claim.
This process is known as subrogation. Based upon the outcome of our investigation as to fault for the above-
referenced accident, we will not be pursuing subrogation. Please note that if we elect not to pursue subrogation,
or discontinue our pursuit of subrogation, you have the right to pursue damages on your own behalf.
